1. Introduction and Parties
These terms and conditions govern the purchase and sale of paid memberships and registrations to the free newsletter through the website vidarbergum.com, and any potential successors (hereinafter referred to as the “Website”), hereinafter referred to as the “Services.”
The seller of the Services is Meze AS, organisation number 929 407 075, Frysjaveien 17B, 0883 Oslo, Norway (hereinafter referred to as the “Seller”). The Seller can be reached at meze@etkjokken.com.
The “Buyer” is the person who purchases a membership or digital products, or signs up for the free newsletter (via the Website or elsewhere).
The contractual relationship arises at the moment the Buyer gains access to free or paid Services. By purchasing or registering for Services, the Buyer accepts these terms and conditions.
These terms and conditions may be updated from time to time. Minor adjustments that do not affect the Buyer’s rights or the price may be made without notice. Material changes to the terms for Buyers with a paid membership will be notified by email in good time before the change takes effect. Buyers who do not wish to continue their membership following a material change to the terms may cancel the membership free of charge with effect from the time that change takes effect. Minor adjustments do not give rise to this cancellation right.
2. Contents of the Services
The purpose of the Services is to teach Buyers Turkish, Middle Eastern and related cuisines, including the background to the dishes and food cultures.
Buyers with a paid membership will receive newsletters and access to the Website as stated at the time of purchase, with any changes from time to time notified to these Buyers.
Membership is an organic service that will develop over time. Changes relating to (but not limited to) content, publication dates and publication frequency must be expected. A notice included in a newsletter is considered sufficient notice of larger changes. Minor changes or delays must be expected without separate notice.
Buyers of annual and monthly memberships will receive the same number of members’ newsletters over a calendar year, but no promises are made as to how many members’ newsletters are published in any given month for monthly memberships. All paying members are welcome to ask questions relating to the content of the Services.
If the Seller is temporarily unable to deliver paid Services as agreed, the Seller may put active memberships on pause. A pause will be notified by email. During the pause period, all payments stop and the membership period is extended by the length of the pause, so that the Buyer receives everything that has been paid for. The Buyer retains access to the archive on the Website during the pause. If the pause exceeds 8 weeks, Buyers of paid memberships may instead claim a refund for the remaining membership period on a pro rata basis.
Buyers of digital products will have access to the specific product as sold.
Buyers who have signed up for the free newsletter will receive newsletters and have access to the Services as determined by the Seller at any given time. The Seller thus has no obligation to send newsletters to, or provide Website access to, Buyers who have signed up for the free newsletter, nor any obligation to announce changes to what free newsletter subscribers receive. The Seller may withdraw and discontinue the free newsletter at any time.
The Seller may continuously develop and adjust the functionality and content of the Website. Material changes to the detriment of paying members will be notified in accordance with Section 1.
3. Prices and Payment
Some content on the Website requires a paid membership. Membership is prepaid and renews automatically until the Buyer actively cancels the membership. The price includes all taxes and any additional costs. Any additional costs not disclosed by the Seller prior to purchase will not be borne by the Buyer. Unless otherwise specified at checkout, prices are in US dollars.
Any price changes for existing Services will be communicated with at least 30 days’ written notice to the Buyer. As long as the Buyer does not actively cancel the membership before the price change takes effect, the membership will renew at the new price. Buyers who do not wish to pay the new price may cancel the membership free of charge with effect from the end of the current period.
At the end of any free trial period, the membership automatically converts to a paid membership and the chosen membership is charged at the stated price, unless the Buyer cancels the membership before the trial expires.
Payment is processed through Stripe. The Buyer is responsible for keeping credit card information or other chosen payment methods up to date. If the chosen payment method cannot be charged at the time of automatic renewal, the Seller may attempt to charge the amount for up to 28 days. The Seller may suspend access to paid Services for as long as the membership payment is overdue and not settled. The Buyer will continue to receive the free newsletter unless the Buyer unsubscribes.
4. Renewal and Cancellation of Membership
All memberships, both free and paid, continue until cancelled.
Paid memberships (including free trials) are cancelled from your account on the Website at any time before a new subscription period begins, or by email to meze@etkjokken.com. Owing to manual processing time, cancellations by email must be received no later than 3 (three) business days before a new period begins.
Memberships that are not cancelled as described above will renew at the then-current price, cf. Section 3 of these terms.
The free newsletter is cancelled by following the unsubscribe link in the most recently sent newsletter.
5. Right of Withdrawal
Buyers may withdraw from the purchase of paid Services in accordance with the Norwegian Right of Withdrawal Act (Angrerettloven). The Act implements the EU Consumer Rights Directive, and consumers resident in the EU/EEA therefore have materially the same 14-day right of withdrawal as under their local law; consumers resident in the UK have equivalent rights under the UK Consumer Contracts Regulations. The Buyer must inform the Seller of the intent to exercise the right of withdrawal within 14 days from the date the withdrawal period commences. This period includes all calendar days. If the deadline falls on a Saturday, public holiday, or other non-working day in Norway, the period is extended to the next business day.
The withdrawal deadline is deemed met if notice is sent before its expiration. The Buyer bears the burden of proof for having exercised the right of withdrawal, so the notice should preferably be in writing (withdrawal form, email, or letter). A standard withdrawal form is available on request from the Seller at meze@etkjokken.com.
The withdrawal period begins at the moment the paid membership starts and the Buyer has gained access to the Service. If the membership includes a free trial period providing the same Services as the paid membership, the withdrawal period begins at the moment the free trial starts and the Buyer has gained access to the Service.
If the Buyer has expressly requested that delivery of the Service start before the withdrawal period expires, the Seller may, where the right of withdrawal is exercised, charge a proportionate amount for the part of the membership period used up until the Seller received notice of the withdrawal, pursuant to Section 26 of the Norwegian Right of Withdrawal Act.
Otherwise, upon receiving notice that the Buyer wishes to exercise the right of withdrawal, the Seller is obliged to refund the purchase price to the Buyer without undue delay, and no later than 14 days from the date the Seller received the Buyer’s notice of withdrawal.
6. Obligations, Rights, and Other Provisions
Meze AS and Vidar Bergum hold all rights to the content on the Website and in newsletters.
Buyers may only use the content for personal, non-commercial purposes.
Each membership and digital product is for the personal use of the number of users it is paid for and may not be shared with others. Legacy Super Supporter memberships include access for up to three users. Members may, however, forward individual newsletters to others on an occasional basis, as long as this is not done systematically to circumvent the requirement that each membership is for the users it is paid for.
Buyers with a paid membership must remain subscribed to the newsletter with a valid email address and keep a valid payment method on file for as long as the membership remains active. Emails returned with a permanent delivery error (“hard bounce”) or multiple temporary delivery errors (“soft bounces”) may result in the Buyer being automatically unsubscribed from newsletters and renewal reminders. In such events, it is the Buyer’s responsibility to resubscribe or change their registered email address.
If the Buyer fails to fulfil the obligations set forth in this agreement, the Seller reserves the right to terminate the membership immediately.
The Services may contain links or references to other websites or services. The Seller is not responsible for any content found on or through such links.
The Seller strives to keep the content accurate and the Services available, but cannot guarantee that the Services are error-free at all times. The Services may for shorter periods be wholly or partly unavailable owing to maintenance or technical problems. Persistent problems with access to the Services should be reported to the Seller. The Buyer’s rights in the event of errors, defects or delays follow from the Norwegian Digital Services Act (digitalytelsesloven) — see Section 7 for what those rights are.
The Seller is not obliged to ensure that the Services are compatible with specific devices, browsers, email clients/apps, or other technical solutions used to view newsletters or websites. The Seller is not responsible if spam filters, a Buyer’s own unsubscribe action, or other similar factors result in newsletters or membership-related emails not reaching the Buyer’s inbox. The Seller is not responsible for user errors.
The Seller reserves the right to discontinue the Services at any time. If the Services cease before the end of a prepaid membership period, the Buyer will be refunded for the part not delivered on a pro rata basis. The refund will be made as quickly as possible and initiated no later than 30 days after the last newsletter is sent (not counting any announced pause period in accordance with Section 2). The refund will be processed using the Buyer’s payment method on file with the payment provider. As per Section 3 of these terms, it is the Buyer’s responsibility to keep payment details updated. If a refund to the registered payment method cannot be completed, the Buyer may request payment by other means, for example by bank transfer. No refunds will be provided for discontinued digital products.
7. Complaints and Defects
If paid Services are defective or are not delivered as agreed, the Buyer may exercise their rights under the Norwegian Digital Services Act (digitalytelsesloven), including claims for rectification, a price reduction or termination. Errors and defects should be reported to the Seller at meze@etkjokken.com within a reasonable time after they are discovered. If paid Services are unavailable for an extended continuous period, the Buyer is entitled to a proportionate price reduction.
8. Personal Data
Use of the Services involves the processing of personal data. Meze AS is the data controller for the personal data. The contact person is Vidar Bergum.
You will find all details about how we handle personal data in our Privacy Policy.
9. Disputes
Complaints should be directed to the Seller within a reasonable time. The parties shall seek to resolve any disputes amicably. If this is not successful, the Buyer may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation at +47 23 40 06 00 or via www.forbrukertilsynet.no. Buyers resident in the EU/EEA can also get free assistance with cross-border complaints from their local European Consumer Centre (ECC-Net).
These terms are otherwise governed by Norwegian law. This choice of law does not deprive consumers of the protection afforded to them by mandatory provisions of the law of the country in which they are resident.
